How does the management of the history of edicts and advertisements work?

In order to promote improved transparency and accountability, in the new version of the service , any announcement or edict that has been published in the e-TAULER will be published in the historical version whenever one of these 2 circumstances occurs:

  • It has NOT been withdrawn before its expiration (that is, if a withdrawal has not been forced before the scheduled deadline).
  • It has NOT been reported when creating the edict or advertisement that it contains personal data (if this option is indicated in the edict, it will not appear in the history once the advertising period has expired).

It is worth noting that the publication of announcements and edicts in a historical is based on the spirit of Law 19/2014, of December 29, on transparency, access to public information and good governance and State Law 19/2013, of December 9, on transparency, access to public information and good governance and also Law 10/2001, of July 13, on archives and document management.

From the point of view of the documentary evaluation tables, the work has been based on the criteria of TAAD 30, which refers to the official publication of edicts and announcements of the Generalitat of Catalonia and other entities or individuals, when appropriate in accordance with the legal system.

Regarding the period of exposure of the information, TAAD 30 specifies that it must be 6 years until its elimination. However, the calculation of time must begin on the date of referral to the Auditor General or external control bodies, and taking into account that this date is much later than the creation of the announcement, it has been agreed that every edict will have a maximum effective period of advertising in the historical section of 8 years (to provide sufficient time for active advertising, which allows the 6-year period to be included by default).

What should I do if I don't want an advertisement or edict to appear in the history?

At any time (whether at the time of publication, already published, or even withdrawn and already recorded in the history), the entity will have mechanisms to decide whether an advertisement or edict should not appear in the history once withdrawn.

Specifically, the management of the visibility of an edict in the historical can be done from the two modalities available for the service. EACAT “white label” screens or via integration (WS), as shown below:

  • With “white label” mode (service management screens via EACAT):

Simply check the “contains personal data” option in the ad management and it will no longer appear in the history. To do this, simply indicate it on the solution management screen as shown below:

Figure 2: Image of the EACAT screen that allows you to select that an advertisement / edict contains personal data:

Check the box Contains personal data

  • With integration modality (WS) in e-TAULER:

The integration model incorporates the possibility of reporting that an advertisement or edict is not displayed by default in the history. To do this, the messaging allows you to optionally report whether the advertisement or edict contains “personal data” . If it is indicated that it does, the edict or advertisement will no longer appear in the history.

For more details on the integration model, you can specifically consult section 3.2 of the documentation published on GITHUB with integration information for e-TAULER , where you will find the optional new features to parameterize, associated with the non-publication of edicts or announcements in the history.

Request for specific data

Therefore, whether with the option via EACAT screens or in the case of an integrated entity via the WS, informing that the advertisement or edict contains personal data, it will no longer appear in the history section once it is removed.
